Terms of Use

Welcome to Jgheer (the "Website"), which together with the corresponding Jgheer mobile application (the "Application"; the Website and Application together, the "Platform") and related services (the "Services") is owned and operated by Fabtechsol ("Fabtechsol", "we", "us", or "our"). The Platform is a real estate classifieds and listings service connecting property buyers, sellers, tenants, landlords, and Agents/Dealers. These Terms of Use, together with our Privacy Policy (collectively, the "Terms"), govern your access to and use of the Platform.

By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Platform. These Terms apply whether or not you create an account: you may browse Listings as a guest, and doing so is also use of the Platform. We may update these Terms from time to time, and continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

1. Definitions

• "Agent" / "Dealer" — a real estate agent, broker, agency, or Posting Agent registered on the Platform under a Dealer account to list Properties on behalf of Owners or Clients.
• "Content" — any text, images, video, data, or other material submitted, posted, or displayed on the Platform.
• "Customer" — a User registered under a Customer account, typically a buyer or tenant browsing and enquiring about Listings.
• "Featured Listing" — a Listing that has been promoted, for a fee and for a set number of days, so that it is displayed above standard Listings in the relevant category.
• "Guest" — a User who browses the Platform without signing in to an account.
• "Listing" — any advertisement or posting relating to a Property, including its description, price, images, video, location details, and contact numbers.
• "Offer" — an amount, with an optional short message, submitted by a Customer through the Platform in response to a Listing.
• "Owner" — the legal or beneficial owner (or authorised representative) of a Property.
• "Posting Agent" — any third party that posts Listings on the Platform on behalf of another person.
• "Property" — any land, plot, house, apartment, commercial unit, or other real estate referenced in a Listing.
• "Registration Details" — information a User provides when creating an account: full name, mobile number, password, account role (Customer or Dealer), and, for Dealer accounts, business name. A Customer also selects a city.
• "User" — any person or entity that accesses or uses the Platform, including Guests, Customers, and Agents/Dealers.

2. Eligibility & Registration

• You must be at least 18 years old and legally capable of entering into binding contracts to use the Platform.
• You agree to provide accurate, current, and complete Registration Details, and to keep this information updated.
• Registration is available as a Customer account or a Dealer account. Your mobile number is your account identifier, and is verified by a one-time code (OTP) sent to you on WhatsApp at sign-up. You must sign in with your mobile number and password after verifying; verification alone does not sign you in.
• Your mobile number cannot be changed from within the Platform once verified. Contact us if it needs to be corrected.
• A Customer account may be converted to, or used alongside, a Dealer account through the "Become a Dealer" and mode-switching features. When you act as a Dealer, the Dealer obligations in these Terms apply to you.
• Fabtechsol may verify the information you provide before activating or continuing to provide access to certain features, including before awarding a verified Dealer badge, and may suspend an account pending that verification.
• You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately if you believe your account has been used without your permission.

3. Nature of the Platform — Important Disclaimer

Jgheer is an online classifieds and listings platform. We provide a marketplace where Users can post, browse, and respond to Property Listings. Fabtechsol is NOT:

• a real estate agent, broker, developer, or dealer;
• a party to any sale, purchase, rental, lease, or other transaction between Users;
• a guarantor, escrow agent, or custodian of any funds, deposits, or token money exchanged between Users; or
• responsible for verifying title, ownership, legal status, or physical condition of any Property listed on the Platform.

All transactions, negotiations, payments, and agreements relating to a Property are strictly between the Users involved (for example, buyer and seller, tenant and landlord). Fabtechsol strongly recommends that Users independently verify property title, ownership documents, and the identity of the counterparty — including through a licensed lawyer, land record office, or other appropriate authority — before making any payment or entering into any agreement.

4. Listings & User Warranties

If you create, submit, or authorise a Listing on the Platform, you represent and warrant that:

• you are the Owner of the Property or have the Owner’s express authorisation to list it;
• all information in the Listing — including price, ownership status, society, block and street, area size, room and feature details, images, and video — is accurate, complete, and not misleading;
• the photographs and video you upload are of the actual Property advertised, and you hold the rights to use them;
• the contact mobile and WhatsApp numbers attached to the Listing are numbers you are entitled to use and are willing to have shown publicly to buyers and tenants;
• the Property is legally available for the purpose advertised (sale, rent, etc.) and is free of any undisclosed dispute, encumbrance, or restriction that would prevent the transaction;
• you will comply with all applicable laws and regulations relating to real estate advertising and transactions in Pakistan (or the relevant jurisdiction).

You are solely responsible for the Content of your Listings. Fabtechsol does not independently confirm the accuracy of any Listing.

5. Listing Review, Rejection & Removal

Listings may be reviewed by Fabtechsol before or after publication. A Listing may therefore appear as Pending while it is being reviewed, or as Rejected if it is not accepted. Fabtechsol reserves the right, at its sole discretion and without prior notice, to remove, edit, suspend, or refuse any Listing that it believes is inaccurate, misleading, fraudulent, duplicated, of poor quality, or otherwise in breach of these Terms.

You may delete your own Listings at any time from the Platform. Deletion is permanent and a deleted Listing cannot be restored by you. Deleting a Listing does not entitle you to a refund of any Featured Listing fee paid for it, and does not remove copies that third parties may already have made or that search engines may have cached.

Fabtechsol is under no obligation to review, monitor, or moderate any particular Listing, and any review carried out is for the benefit of the Platform, not a warranty to any User.

6. Offers, Contact & Marking a Property as Sold

Offers are not binding contracts. An Offer submitted through the Platform is an expression of interest and an invitation to negotiate. It does not create a contract of sale or tenancy, does not reserve a Property, and imposes no obligation on either party. A Dealer is under no obligation to respond to or accept any Offer.

When you submit an Offer, your name, mobile number, the amount offered, and any message you include are shown to the Dealer who posted the Listing, so that they can contact you. Do not submit an Offer if you do not wish to share these details.

Contact happens outside the Platform. The Platform does not provide in-app messaging. Tapping Call opens your own phone dialler, and tapping WhatsApp opens WhatsApp with the Dealer’s number. Those calls and messages are not carried, recorded, or monitored by Fabtechsol, and are subject to the terms of your mobile operator and of WhatsApp (Meta).

The Platform records that a Call or WhatsApp button was tapped, and counts such taps, Offers, and Listing views as "leads" and statistics shown to the relevant Dealer. These counts are indicative only, are not audited, and must not be relied on as a measure of guaranteed business.

"Mark as Sold" is a record-keeping feature that lets a Dealer close out a Listing. It is a status update on the Platform only. It does not transfer title, does not evidence or complete a transaction, does not create any obligation between the parties, and does not entitle Fabtechsol to any commission on the sale.

Fabtechsol charges no commission or brokerage on any Property transaction, and is not entitled to any share of a sale or rental price.

7. Dealer Accounts, Verification Badge & Public Profile

A Dealer’s business name, logo, cover photo, "About" description, coverage areas, contact numbers, and Listings are shown on a public Dealer profile that is visible to all Users and to visitors of the Website. Do not publish anything there that you do not want to be public.

The verified badge is limited in meaning. A green verification mark next to a Dealer indicates only that Fabtechsol has carried out a basic check of the information that Dealer provided to us. It is not a warranty or endorsement of that Dealer’s honesty, solvency, licensing, or conduct, is not a verification of the title, ownership, or condition of any Property they list, and must not be treated as a substitute for your own due diligence.

Fabtechsol may award, withhold, suspend, or withdraw a verification badge at any time, at its sole discretion.

You must not copy, imitate, or display a verification mark, or otherwise represent yourself as verified, unless Fabtechsol has awarded that status to your account.

8. Featured Listings & Payments

Posting a standard Listing on the Platform is free. Dealers may optionally purchase a Featured Listing package to promote a Listing above standard Listings for a set number of days.

How payment works. The Platform does not process card payments and does not take payment inside the app. You transfer the package price yourself using JazzCash, Easypaisa, or a bank transfer, to the account details displayed on the payment screen, and then submit the Transaction ID and a screenshot of your payment confirmation.

Manual verification. Your submission is checked by a member of our team before the Listing is Featured. Verification usually takes a short time but is not instant and no specific turnaround is guaranteed. Your Listing stays live as a standard Listing throughout.

Incorrect or unverifiable proof. If the Transaction ID or screenshot cannot be verified, if the amount transferred does not match the package price, or if the payment is reversed, the Featured status may be refused or withdrawn without refund. Keep your Transaction ID and screenshot until the Featured status is confirmed.

No guarantee of results. A Featured Listing is a placement service only. Any figures shown in the app or in our marketing about additional views, leads, or ranking are estimates based on past averages and are not promises. Fabtechsol does not guarantee any number of views, enquiries, offers, or sales, or any particular position in search results or feeds.

No endorsement. Purchase of a Featured package does not constitute verification, approval, or endorsement of the Listing or the Dealer by Fabtechsol, and does not exempt the Listing from review, rejection, or removal under section 5.

Fees are non-refundable once the Featured period has begun, except where required by law, or where Fabtechsol fails to deliver the Featured placement for reasons within our control. Fees are not transferable between Listings or accounts.

Package prices, durations, and payment methods may change at any time. The price shown at the time you select a package is the price that applies to that purchase.

If a Listing is removed for breach of these Terms, any remaining Featured period is forfeited without refund.

9. Prohibited Conduct

You agree not to use the Platform to:

• post false, fraudulent, duplicate, or misleading Listings, including "bait" listings not genuinely available;
• upload photographs or video that are not of the advertised Property, or that you do not have the right to use;
• impersonate any person or entity, or misrepresent your affiliation with any person, Property, Agent, or with Fabtechsol;
• solicit or collect payments, deposits, or token money under false pretenses, or direct Users to make payments outside legitimate, verifiable channels;
• submit false Offers, or submit Offers with no genuine intention of proceeding;
• submit a forged, altered, or reused payment screenshot or Transaction ID for a Featured Listing;
• use contact details obtained through the Platform for spam, unsolicited bulk messages, telemarketing unrelated to the Listing, or phishing;
• scrape, harvest, or extract data or Listings from the Platform without authorisation, including by automated means;
• upload Unacceptable Content, or content that facilitates money laundering, illegal gambling, or other unlawful activity;
• interfere with, disrupt, or attempt to gain unauthorised access to the Platform, its servers, or other Users’ accounts;
• create multiple accounts to evade a suspension, inflate statistics, or circumvent any limit.

Violation of this section may result in immediate suspension or termination of your account, removal of Content, forfeiture of any Featured Listing fee, and — where applicable — reporting to law enforcement authorities under the Prevention of Electronic Crimes Act (PECA) 2016 or other applicable law.

10. Fraud Reporting

If you suspect a fraudulent Listing, an impersonation, a fake verification badge, or a scam attempt on the Platform, please report it immediately to info@fabtechsol.com with the Listing details and any screenshots. Fabtechsol will investigate reported Listings and accounts in good faith but does not guarantee the prevention or detection of all fraudulent activity, and Users remain responsible for exercising independent diligence before transacting.

11. Device Permissions

To use certain features, the Application may request access to your device Camera (to photograph or record a Property, or take a profile or business picture), your Photo Library (to attach existing images or video to a Listing or profile, and to upload a payment screenshot), and permission to send Notifications (for account, Offer, saved-search, and payment alerts). You may grant, deny, or revoke these permissions at any time through your device settings, and you can turn notifications off inside the Platform; some features will not function if the related permission is denied. The Application does not request access to your device location, contacts, microphone, WhatsApp messages, or call logs.

12. Intellectual Property & Content Licence

All trademarks, logos, design, software, and Content on the Platform (excluding User-submitted Content) are the property of Fabtechsol or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Platform Content without our prior written consent.

You retain ownership of the Content you submit. By submitting Content (including Listings, images, and video), you grant Fabtechsol a non-exclusive, worldwide, royalty-free, sub-licensable licence to host, store, use, reproduce, adapt in format or size, display, and distribute that Content in connection with operating and promoting the Platform. This includes displaying your Listing photographs and video in the Platform’s public video feed, search results, and Dealer profiles, and using them in promotional material for the Platform. This licence continues for a reasonable period after a Listing is deleted, to the extent necessary for backups, records, and material already published.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Fabtechsol, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or financial loss, arising out of or in connection with:

• your use of, or inability to use, the Platform;
• any transaction, negotiation, Offer, or agreement entered into with another User;
• reliance on any Listing, verification badge, statistic, Content, or information displayed on the Platform;
• any fraud, misrepresentation, or unlawful conduct committed by a User or third party;
• any communication that takes place by telephone or WhatsApp after you leave the Platform.

The Platform and all Content are provided "as is" and "as available", without warranties of any kind, express or implied, including as to accuracy, completeness, uninterrupted availability, or fitness for a particular purpose. Where liability cannot lawfully be excluded, our total aggregate liability to you is limited to the amount you have paid to Fabtechsol for Featured Listings in the three months before the event giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless Fabtechsol, its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or connected with: (a) your use of the Platform; (b) your breach of these Terms; (c) any Listing, Offer, or Content you submit; or (d) your violation of any law or the rights of a third party.

15. Account Suspension, Termination & Deletion

Fabtechsol may suspend or terminate your access to the Platform, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent or unlawful conduct, or posed a risk to other Users or the Platform. On termination, your Listings may be removed and any remaining Featured period is forfeited without refund.

You may stop using the Platform at any time and may delete your Listings yourself. To delete your account and personal data, contact us at info@fabtechsol.com from your registered details, as described in our Privacy Policy. Sections that by their nature should survive termination — including sections 3, 12, 13, 14, and 16 — continue to apply.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Sialkot, Punjab, Pakistan.

17. Changes to These Terms

Fabtechsol may revise these Terms at any time. Material changes will be notified through the Platform, including by push notification where you have enabled notifications. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
